The Supreme Court on Tuesday handed a victory to the Obama administration by upholding a major Environmental Protection Agency regulation. The Supreme Court ruled that the EPA acted within its rights in requiring 28 states to limit pollution causing unhealthy air in neighboring states. Justice Ruth Bader Ginsburg wrote the majority opinion, saying it was permissible for the EPA to impose cross-border emissions limits that are harder for down-wind states to meet. Justices Antonin Scalia and Clarence Thomas dissented. Justice Samuel Alito recused himself for undisclosed reasons.
